JAMMU: Justice Tashi Rabstan of J and K High Court Jammu Wing while issuing notices to Deputy Commissioner (DC) Anantnag and others directed the DC Anantnag to protect the property of petitioner strictly under the provisions of J and K Migrant Immovable Property Act 1997 and also directed him to file status report before the next date of hearing.
The directions came in response to a petition filed by Prabha Wati Raina against State of J and K through Revenue Department, Divisional Commisioner Kashmir, DC Anantnag and others. In the petition filed through Advocate S.M Choudhary, it has been submitted that the petitioner is the owner of a chunk of land and because of turmoil in Kashmir valley, she migrated to Jammu. The land, according to the petitioner is to be protected in accordance with the provisions of J and K Migrants Immovable Property Preservation, Protection and Restrained on Distress Sales Act 1997 and DC Anantnag under the Act becomes the custodian of the land in dispute. The grievance of the petitioner was that private respondents have encroached upon the aforementioned chunk of land. JNF
