GAD Comm Secy defies HC order; court expresses displeasure

JAMMU: Expressing displeasure over the non-appearance of Commissioner/Secretary General Administration Department (GAD) Khurshid Ahmed Shah in the court, the J&K High Court Jammu Wing in open court passed strict orders on Wednesday.
On 24th May, Justice Alok Aradhe of J&K High Court Jammu Wing had issued bailable warrants amounting to Rs.10,000 against Commissioner/Secretary General Administration Department (GAD) Khurshid Ahmed Shah  for securing his presence in SWP No.1932/2015.
This Court vide order dated 7th April 2017 had directed that in case the respondents are unable to produce any order from the Division Bench, Khurshid Ahmed Shah, Commissioner/Secretary General Administration Department Government of Jammu and Kashmir shall remain present before the Court on 20th April 2017.
However, on 29th April 2017, the matter was adjourned at the request of Seema Shekhar, Senior AAG. “Thereafter, neither the respondents filed compliance report nor have produced copy of any order passed by the Division Bench”, Justice Alok Aradhe observed adding that under these circumstances, this Court is left with no option but to issue bailable warrants amounting to Rs.10,000 for securing the presence of respondent No. 1 namely Khurshid Ahmed Shah, Commissioner/ Secretary General Administration Department, Government of Jammu and Kashmir on the next date of hearing. ‘Let the warrants be executed through SSP concerned on the aforesaid respondent”, the court had observed.
However, today, the Commissioner/Secretary General Administration Department (GAD) Khurshid Ahmed Shah again didn’t appear in the court as May 31 was fixed as next date of hearing. In this case, the High Court has taken strong note and shall issue the fresh orders tomorrow, said an advocate.
