Fraudsters dupe two insurance firms; CB unearths scam

JAMMU: Crime Branch, Jammu on Tuesday unearthed a scam in which the fraudsters cheated insurance companies and drew the insurance twice.
The Crime Branch received a complaint under reference No. JISPL/16-17/0135 dated 1st Spetember, 2016 along with enclosures made by Managing Director, Jehlum Investigating Services Private Limited Imtiaz Ahmed Bazaz alleging that while investigating the cases entrusted by M/s HDFC ERGO General Insurance Company Limited, Delhi regarding Insurance claim No. C241215013860 under policy No. 2412201221091700000 of Wani Enterprises, Sallar, Anantnag owned by one, Rafi Ahmed Wani and M/s TATA AIG General Insurance Company Ltd. regarding insurance claim 895361 under policy No. 0840015366 of Wani International Walnut Industry owned by Shakeel-ur-Rehman Wani with respect to the damage to the stocks of walnut kernels due to a road traffic accident at Chenani, Udhampur on 27th November, 2015 under FIR No. 107/15 Police Station Chenani, it was found an accident occurred on 27th November, 2015 at Chenani and accordingly, the insured preferred a claim of compensation of the insured amount but by concealing the material facts.
It was further alleged that the insured (Wani Enterprises) had got the consignment of walnut kernels insured with M/s HDFC ERGO General Insurance Company Ltd. vide policy No. 2412201221091700000 for 14,145 kg of walnut kernels with declared value of Rs. 1,81,69,745 in the name of Wani Enterprises Sallar, Srigifwara, Anantnag, the insurance cover of which was sought on 25th November, 2015 and the consignment was dispatched through Jehlum Road-lines Pvt. Ltd to M/s S K Traders, Mumbai. The same consignment of 14,145 kg of walnut kernels was also insured through M/s TATA AIG general Insurance Company Ltd. with a declared value of Rs. 1,81,69,745 in the name of Wani International Walnut Industry, SIDCO Complex Shalteng Industrial Estate, Srinagar and insurance cover was also sought on 25th November, 2016 and the consignment was again dispatched through the same, Jehlum Road-lines Pvt. Ltd to M/s S K Traders, Mumbai. However, after the alleged accident on 27th November, 2015 of the vehicle truck bearing registration No. JK03B-9156 at Chenani, separate claims were made by the insured before HDFC ERGO and TATA AIG for an amount of Rs. 3.62 crore on account of loss of the consignment. But when the company surveyors investigated the matter, it was found that only about 1,790 kg walnut kernels were found from the alleged spot without any reasonable evidence of an accident. It also came to light that the vehicle was deliberately pushed with a criminal intention to defraud two insurance companies and seek compensation amounting to crores of rupees.
The aforementioned facts clearly show that the accused proprietors, Rafi Ahmed Wani and Shakeel-ur-Rehman Wani, in furtherance of a criminal conspiracy got a fraudulent consignment of 14,145 kg of walnut kernels insured through two different insurance companies separately under different proprietorship and thereafter, created and conducted an accident at Chenani.
The accused got a criminal case registered and filed the respective claims before both the companies by preparing fake and fraudulent documents seeking compensation of the insured amount by resorting to fraudulent means in order to cheat both the companies and cause wrongful gains to themselves and wrongful loss to the insurance companies.
The omissions and commissions, therefore, on the part of Rafi Ahmed Wani and Shakeel-ur-Rehman Wani, prima facie, constitute offences punishable under Sections 420, 465, 466, 467, 468, 471, 120-B RPC.
