JAMMU: First Additional Sessions Judge Jammu M.A Chowdhary on Saturday awarded five years imprisonment to Amarjeet Singh alias Happy, son of Prem Singh, resident of Camp Gole Gujral, Jammu in a murderous attack case.
According to the police, ASI Rakesh Bamba recorded a verbal report on 6th November 2004 lodged by one Parkash Chand a Karyana merchant of Bohri Chowk that one Amarjeet Singh alias Happy attacked Havaldar Suram Singh of Traffic Police on duty in front of his shop with an intention to kill inflicting serious injuries to the cop with a ‘Dah’. The injured was shifted to GMC Jammu and Amarjeet Singh was caught by some persons at Bohri Chowk along with a blood stained Dah.
In this regard, a case was registered at Police Station Domana vide FIR No. 249/2004 for the commission of offences punishable under Sections 307 and 332 RPC and 4/25 Arms Act. After investigation of the case, the instant chargesheet was laid for the commission of offence punishable under sections 307, 332 and 325 RPC and 4/25 Arms Act.
After hearing Additional Public Prosecutor Ajay Singh Manhas appearing for the State, Court convicted accused and sentenced him to imprisonment for a term of five years and fine of Rs. 30,000 for the commission of offence under section 326 RPC. He is sentenced to a fine of Rs. 20,000 for the commission of offence under section 332 RPC. The convict is further sentenced to undergo an imprisonment for a period of three years and fine of Rs. 20,000 for the commission of offence under section 4/25 Arms Act. All the substantive sentences of the imprisonment shall run concurrently. The period of detention if any undergone by the convict- Amarjeet Singh during investigation or as undertrial shall be set off under rules. In default of payment of fine, the convict shall undergo further simple imprisonment for a period of one year. Fine, if realized, an amount of Rs. 60,000 shall be paid as compensation to the victim Suram Singh, out of fine, in terms of Section 545 CrPC.
