Disappearance of girl since 2014;HC directs SHO G’Nagar to file status report

JAMMU: Justice B.S Walia of J&K High Court Jammu Wing in a Habeas Corpus Petition directed the Station House Officer (SHO), Gandhi Nagar to file fresh status report in case regarding disappearance of a girl in 2014.
The Habeas Corpus Petition was filed by mother of the girl (names withheld) who was missing from her grandfather’s residence since August 2014. Counsel for the petitioner Advocate Aditya Sharma pleaded before Justice Walia that daughter of the petitioner is missing since August 2014 and her whereabouts are not known till date. Subsequently, Justice Walia had directed the SHO Gandhi Nagar to appear in person and tell the exact position of the case. SHO, Gandhi Nagar appeared in person and disclosed that efforts were made but they are not able to succeed in tracing out the girl.
Advocate Aditya Sharma further pleaded that the petitioner is having the apprehension that her daughter might have been murdered and buried in the residence of the private respondent at Nai Basti, where a religious structure has been raised.
He alleged that the religious structure had come into being only after the disappearance of the girl as the same was not there until August 2014.
He further alleged that a direction was issued by the Court on 2nd September,2016 to file status report and since then petitioner had been continuously receiving the threats from the private respondents and are forcing her to withdraw the case else she will face the consequences.
Justice Walia directed the SHO concerned to conduct the enquiry and take help of the Wakf Board as well and file the fresh status report with respect to the existence of the religious structure at the residence of the private respondent within the
period of six weeks and matter be again listed in the week commencing 26th December, 2016.
