Different revenue extracts of same land: SVO registers FIR against Revenue Officers/ Officials

JAMMU: The State Vigilance Organisation (SVO) has registered an FIR against the Revenue Officers/Officials for issuing of different Revenue Extracts of same property. A verification conducted into the allegations levelled against revenue officials of Tehsil Bishnah and some private parties which revealed that Gagu, son of Fulla and his other family members were in possession of land measuring 16 Kanal and 15 Marlas in Khasra No. 217 at village Mehmoodpur, Bishnah, Jammu as per Khasra Girdwari Register of village Mehmoodpur with effect from 1969 to 2001. The land belonged to Custodian Department and these people were also shown as local allottees in the revenue record.
On January, 13, 2001 the revenue officials cancelled the Sahat Kasht Girdwari of Gagu alias Gagi, son of Fulla and others and entered the name of Late Sheela Wanti, wife of Khayali Ram in their place illegally. On the basis of the afore mentioned illegal entries, Tehsildar finally mutated the land measuring 9 Kanal and 11 Marlas in Khasra No. 217 at Village Mehmoodpur, Bishnah under section 3-A Agrarian Reforms Act in favour of Late Sheela Wanti for which he was not competent authority. One Satish Kumar, son of Lachman Dass, resident of Bishnah is also found having obtained the Power of attorney of the said land and finally purchased the land in question from Sheela Wanti illegally for a sum of Rs. 80.000 knowing the fact that land in question is Evacuee Property and cannot be purchased. The Custodian Evacuee Property, Jammu in his Judgment dated May 27, 2011 has declared the mutation of the said land as void-abintio. He has also held the allotment order dated January, 24, 2001 as non-existent and consequent attestation of the mutation Under Section 3-A Agrarian Reforms Act as null and void.
It is also observed that the parties (Sheela Wanti, wife of Khayali Ram) in connivance with revenue authorities (Tehsildar and Patwari) and Power of attorney holder (Satish Kumar, son of Lachman Dass) have defrauded the department by forged entries in the revenue records and plundered property worth lakhs of rupees by mutating the Evacuee property land in question illegally.
In view of the above facts the revenue officials namely Pawan Kohli, the then Tehsildar Bishnah, now retired and then Patwari concerned namely Waryam Singh have misused their official position by making forged entries in the revenue record and further effected mutation of Evacuee Property in the name of Sheela Wanti without authority in connivance with the private persons namely Satish Kumar and Sheela Wanti, wife of Khayali Ram, resident of Mehmoodpur Tehsil Bishan, Jammu. The aforementioned acts of omissions and commissions on part of the above revenue officials as well as private persons constitute offences punishable under section 5(1) (d) read with Section 5(2) J&K PC Act, 2006 and Sections 468, 471 and 120- B RPC. FIR 7/16 has been registered and further investigation has been set in motion.
