Delay in copy of report leads to quashing of proceedings: HC

JAMMU: In a petition filed by one cop Kafait Ullah, who was terminated by the department on the grounds that one detenue escaped from his custody, Justice Janak Raj Kotwal while quashing the inquiry report observed that this is a fit case for terminating the disciplinary proceedings for the inordinate delay in concluding the proceedings caused by unexplained delay of six years in providing the petitioner the copy of the inquiry report after the disposal.
Justice J.R Kotwal allowed the petition on merit and quashed the entire disciplinary proceedings as also the report of the Inquiry Officer dated 7th December, 1998 and it is directed that petitioner be reinstated in service forthwith. However, in tune with the judgment of Supreme Court, he shall be paid 50 per cent of the back wages keeping in view the fact that he has not worked in the department during this period. He shall, however, be entitled to seniority and other benefits under rules.
