JAMMU: A Division Bench of state High Court Comprising Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal decided appeal of conviction in murder case after 13 years and uphold the trial of Tarlochan Singh who was convicted by the Trial Court in murder of Parsan Kour over the issue of diverted the course of water from his land towards their land.
Division Bench after hearing Adv SK Anand appearing for the accused whereas AAG Rakesh Khajuria appearing for the state observed that no good reason for rejecting the altogahter the prosecution case, which is supported by the direct evidence in regard to the involvement of the appellant and further observed that trial court has carefully and properly appreciated the evidence separated grain from chaff and applied settled principles of law while recording the conviction and imposing the sentence. With these observations, Division Bench uphold the conviction and sentence and directed accused to surrender before the trial Court within two weeks for undergoing the sentence and in case of failure, trial court shall proceed in accordance with law so that the sentence is executed.
