JAMMU: In a Public Interest Litigation filed by one Varun Jamwal for calling for record of the advertisement notice No.1 dated 21/02/2014 issued by the Commissioner/Secretary PWD in pursuance to Development Commissioner Work’s letter No. PW/DCW/14/268-70 dated 6th January, 2014 whereby applications have been invited for recruitment of Gang Coolies from the permanent residents of Jammu, Samba and Kathua and quashing the same being arbitrary and discriminatory.
A Division Bench (DB) of State High Court comprising Chief Justice M.M Kumar and Justice Tashi Rabstan after hearing Advocate H.C Jalmeria appearing for the PIL, AAG Seema Shekhar with Deputy AG D.S Jamwal for the state, observed that order dated September 18, 2014 requiring the respondents to file status report has not been complied with and directed the status report be now filed within four weeks, failing which, the Commissioner/Secretary to Government, PWD Department (R&B) Jammu shall remain present in person.
In the PIL it has been submitted that in the advertisement that pay and allowances for initial period of five years of service shall be governed by the Govt. order No. 257-F of 2011 dated 27th October, 2011 vide this order fixed salary for first two years shall be Rs. 3,170 and for next three years shall be Rs. 4,610. The advertisement is discriminatory and speaks of implementing Govt. order No.257 – F of 2011 which stands repealed and withdrawn. JNF
