DB refuses to suspend life imprisonment of CRPF Jawan for killing Inspector, 2 others at CM’s residence

JAMMU: A Division Bench of J&K High Court dismissed an application filed by an accused CRPF Jawan seeking suspension of life-Imprisonment for killing Inspector, 2 others in CM’s residence.
According to prosecution case, on April 3, 2006, accused CRPF constable namely Anand Kumar Singh, son of Ram Naresh Singh of Bihar shot dead Inspector Mohan Shyam from his Insas rifle over an old enmity at Chief Minister’s residence, Wazarat road, Jammu. He also killed two Havildars namely Joginder Jha and H N Pandey, when they tried to nab accused Jawan.
Accordingly, a case was registered at Peer Mitha Police Station under sections 302 RPC and 30 of Arms Act. During the course of investigation, the accused CRPF Jawan was arrested and on his disclosure weapon of offence and other ammunition, which was issued in his favour by CRPF, was recovered. After completion of investigation, Police presented challan in the court of law. Trial Court convicted accused Anand Kumar Singh and awarded him life-imprisonment.
DB observed that prayer made in present application is for suspension of sentence of applicant, who has been convicted to undergo life imprisonment after conviction in FIR No. 18/2006, registered at Police Station Peer Mitha, under sections 302 RPC & 30 Arms Act. DB after hearing AAG Aseem Sawhney for the J&K observed that it is a case in which applicant/appellant had been convicted for killing his colleagues namely Inspector Shyam, No. 891320177, Havildar Joginder Jha, No. 860230071 and Havildar H N Panday, No. 830762272, when he was on duty as CRPF security personnel at house of the then Chief Minister of erstwhile State of Jammu & Kashmir.
DB after hearing both the sides observed that it is not a fit case for suspension of sentence, at this stage and as such, dismissed application accordingly.
