Crime Branch’s 5-member SIT to probe activities of Moulana Ali Miyan Nadwi Charitable Trust

Misuse of foreign contributions, financial aid from foreign NGOs

JAMMU: Five-member Special Investigation Team (SIT) headed by a senior Deputy Superintendent of Police (DySP) shall investigate the FIR (27/23) registered under Foreign Contribution (Regulation) Act with the Economics Offences Wing (EOW) of Jammu Crime Branch to probe misusing of funds received from various foreign based NGOs contrary to the aims and objectives described in trust deed of Moulana Ali Miyan Nadwi Educational and Charitable Trust (MAMNECT)Bathindi Jammu.
The main accused Moulana Shakeel-Ur-Rehman Bhat, son of Ab. Hamid Bhat, resident of Sangaldan Gool District Ramban at present Aisha Nagar Bathindi Jammu, has allegedly constructed numerous religious centres and so-called vocational centres on encroached government lands in J&K. Even at one of such centres at Bhatindi, over 150 girls are admitted and none was given summer vacations this year fearing that the government may demolish or seize the illegally constructed building at Bhatindi.
Sources said that the detailed probe will expose many scandals operating under this Trust. Keeping in view the vast financial scam and anti-national activities, a five-member SIT has been constituted to probe the entire scandal.
The initial probe was ordered after receiving Home Department’s communication No. Home-VPN/160/2022-01-Home [CC;7068034] dated March 6, 2023 regarding periodical screening and monitoring of Foreign Contribution (Regulation) Act. 2010 (FCRA) licence holders operating in J&K and communication dated Dec 21, 2022 of Divisional Commissioner Jammu and communication dated Feb 24, 2023 of Special Director General of Police (CID) J&K regarding Moulana Ali Miyan Nadwi Educational and Charitable Trust Bathindi Jammu (MAMNECT) for violating the provisions of FCRA and for misusing the funds for the purpose outside the mandate of Trust. Further inputs reveals that the Trust/Association headed by the Moulana Shakeel-Ur-Rehman Bhat, son of Ab. Hamid Bhat, resident of Sangaldan Gool District Ramban at present Aisha Nagar Bathindi Jammu in connivance with Gowhar Ayoub, son of Mohd. Ayoub , resident of Maitra Tehsil and District Ramban at present resident of 158 ESWYN Road SW 198 TN London UK and others have committed criminal breach of trust by misusing Foreign Contributions/Financial Aid received from various NGOs based in foreign countries contrary to the aims and objectives described in the trust deed of Moulana Ali Miyan Nadwi Educational and Charitable Trust Bathindi Jammu (MAMNECT) intentionally and fraudulently for their personal gain and in contravention to Foreign Contribution (Regulation) Act. 2010.
The omissions and commissions, thereof, on the part of Moulana Shakeel-Ur- Rehman Bhat and Gowhar Ayoub and others prima facie constitute offences punishable under sections 35 FCRA r/w 107, 409, IPC. Accordingly, FIR is registered with (EOW) Crime Branch, Jammu for detailed probe.
