JAMMU: Crime Branch (CB), Jammu on Thursday produced Challan against Assistant Engineer (AE) Migrant Girdhari Lal, son of Prem Nath, resident of 367-B, Durga Nagar Sector-I, Jammu before the Court of Chief Judicial Magistrate, Jammu for producing fake certificate and managing fraudulent promotion orders.
On the basis of a complaint of Relief and Rehabilitation Commissioner (M), Jammu, case FIR No. 21/2011 under Sections 420, 465, 467 and 471 RPC was registered in CB against Girdhari Lal posted in the Engineering Wing of Relief Organisation who was promoted to the rank of Assistant Engineer on the basis of a fake/fictitious promotion order as the said order was not issued by any competent authority. Further, the diploma certificate which he had produced was also not genuine because institution from which the certificate is claimed to have been attained does not exist. During verification, when he was asked to produce the said promotion orders, he submitted two orders one signed by Bashir Ahmed Sofi, Deputy Director Urban Local Bodies, Kashmir and the other signed by Vinod Koul in the capacity of then Director Urban Local Bodies, Kashmir in April 2005 which actually has not been signed by him and in fact, as Director he was not competent to promote a Junior Engineer to the post of Assistant Engineer.
During the course of investigation, it was found that the personal file number of accused Girdhari Lal was 1093 and in the fake promotion order in question instead of 1093 it was mentioned as 1094. When the matter was probed further, it was found that no such promotion order was ever processed or issued by Director of Urban Local Bodies Kashmir. The promotion order also purported to have been issued by Vinod Koul, Director of Urban Local Bodies Kashmir who was not competent to issue such order for the Gazetted Services. The seniority process with regard to promotion of accused Girdhari Lal was already under process but prior to its recommendation accused Girdhari Lal with the criminal intention managed fraudulently and dishonestly a fake promotion order purported to have been issued by then Director Urban Local Bodies Kashmir in order to get undue benefit of promotion.
From the evidence, oral as well as documentary collected during investigation of the case, the accused person was found to have committed the offences and was accordingly Challaned in the Court of law.
