Court rejects bail of smuggler

JAMMU: Principal Sessions Judge Jammu R.S Jain rejected the bail application of Mehar Ahmed Bhat who was facing trial in alleged smuggling of poppy straw.
According to the police on 17th November, 2014 the patrol party of Police Station Gangyal, Jammu stopped truck being driven by accused and on checking the truck, two bags were recovered which on opening were found to contain poppy straw weighing 30 kg. Accordingly FIR No.160/2014 for offence under Section 8/15 NDPS Act was registered in Police Station Gangyal against the accused the accused
Principal Sessions Judge Jammu R.S Jain observed that in the present case, accused was having in their possession of 30 kgs of poppy straw. The question arises, should the accused be keeping such a large quantity of poppy straw in their possession and if they are keeping the illicit drug in such a large quantity in their possession while on the street, it cannot be obviously for their personal use but rather to deal in illicit trade of selling the same to the drug addicts.
Keeping in view the enactment of the NDPS Act is to curb the ever increasing menace of drug peddling and illegal sale and its ramifications on the society and the youth in particular and cause for increase in the crime rate, nature and seriousness of accusation against the applicant, with these observations Court rejected the bail application.
