JAMMU: CJM Shopian Iqbal Ahmed Akhoon rejected bail application of one Shafat Ahmad Shiekh, who was involved in issuing fake SIM cards.
According to police, on June 18, 2022 Police Station Shopian received information from reliable sources that few SIM venders have prepared forged documents and by putting photographs of different people, thereby deceiving people, had issued illegal SIM cards to earn money. On receiving report, FIR was lodged and petitioner was arrested. The petitioner has also confessed before the police that he had prepared forged documents and has issued SIM cards. At the instance of petitioner, police seized a dairy and CAF on ESU Shopian as a piece of evidence. The investigation with regard to CAF form holder is yet to be conducted.
CJM Shopian Iqbal Ahmed Akhoon, while rejecting bail application, observed that number of forms through which SIM cards have been issued, were recovered from applicants and accused has admitted to have issued SIM cards by way of illegal means using forged documents. “The offence for which the accused was arrested are not only heinous but are serious in nature and is not only against Government but also public at large. Also, investigation of the case is at its infancy and if the accused is enlarged on bail at present moment, when the investigation of case is going on, there is every likelihood that applicant will try to hamper or temper prosecution evidence and win over the witnesses. The police has yet to record the statement of material witnesses and yet to complete the investigation. When investigation is going on and the accused is involved in such a heinous offence, enlarging the accused at this movement of time will be prejudicial to the investigating agency. The investigation is going on and applicant being allegedly involved in serious and heinous offence is not entitled for bail at this time,” the Court observed.
