Court rejects bail of one in SI Exam in ED case

JAMMU: Special Judge CBI Bala Joyti today rejected the bail application of one Anil Kumar Yadav who was arrested by Enforcement Directorate in SI Paper Scam.
Special Judge CBI Bala Joyti after hearing Adv Asheesh Singh Kotwal for the applicant whereas Special PP Ashwani Khajuria for the ED, observed that after consideration of entire material on record it is held that for the foregoing reasons, I am, not inclined to grant bail to the applicant/accused at this stage who is accused of serious offence caught by ED on the basis of ECIR No. ECIR/JMSZO/01/2023 dated March 31, 2024, hence to my mind keeping in view the aforementioned facts and circumstances, it appears that on the strength of documents, it is not proper to admit the applicant/accused to bail at this stage as till date he has failed to carve out a case in his favour as this Court is not satisfied that there are reasonable grounds for believing that he is not guilty of such offence and further he is not likely to commit any offence while on bail. Moreover there is plenty of incriminatory material against him on record.
Suffice it to say that applicant/accused is unable to make out a case for bail in terms of section 45 of PMLA, moreover Economic offence constitute a class apart & need to be visited with a different approach, besides there is every likelihood that he will severely hamper the ends of justice as there is every likelihood of his flight risk, tampering with the evidence as there is no manner of doubt that once he comes out on bail, he will influence the witnesses purposed to be examined by the prosecution as he wields considerable influence due to his financial clout.
Therefore, in this case principle that “Bail is Rule and Jail is an exception”, is not attracted in the case in hand. Thus in view of above said, prayer made herein is declined and application for bail is accordingly rejected.
