JAMMU: Took serious note of non-compliance of Court orders by State Forest Corporation, the Railway Magistrate Jammu R K Lalhal froze bank account of State Forest Corporation.
When case came-up for hearing, Railway Magistrate Jammu R K Lalhal observed that perusal of the file revealed that instant execution petition came to be filed on 07.04.2008 pursuant to passing of the decree dated May 15, 2007 passed In a file no. 45/Civil,: July 20, 1999 & D.O.D: May 15, 2007. “Perusal of the file revealed that Counsel Anita Tickoo appeared on behalf of judgment debtors on October 31, 2008 and sought time to file objections. On May 15, 2009, again the Counsel for the Judgment debtors sought opportunity to file objections. Even on January 17, 2018, Shah Faisal Field Supervisor appeared on behalf of judgment debtors. Despite of ample opportunities, judgment debtors did not bother to file the objections. Perusal of the file reveals that this execution petition is pending for the last more than 15 years for a meager decretal amount of Rs 18,600 along with Interest @ 10 per cent per annum from the date of filing of suit till It is liquidated as ordered by the court. It is surprising and unfortunate that decree holder is appearing for the execution of the same for the last more than 15 years and Judgment Debtor did not bother for same. Now the court is left with no option other than taking the coercive measures to recover the decretal amount and to get the fruits of the decree in favour of decree holder. Accordingly, bank account of the judgment debtors State Financial Corportaion is freezed till the realization of the amount or further order,” the Court observed.
