JAMMU: Principal Sessions Judge Jammu R.S Jain on Monday framed murder charges against accused Nirmal Singh for committing the murder of Bua Ditta and discharged Vicky Thappa for the offence under Section 212 RPC.
Justice Jain observed that whether a quarrel is sudden or not must necessarily depend upon the facts of each case and the grounds relied upon by the defence for discharge would be a matter of evidence. He said that the facts, as appearing in the challan are that accused attacked the victim and thereafter pushing him to the ground hit him repeatedly with a stone on the head which resulted in the death of Bua Ditta. Jain said that whether the crime allegedly committed by accused Nirmal Singh is culpable homicide of first, second or third degree can be adjudicated only after evidence is led during the trial. He said that looking into the evidence collected by the Investigating Officer, allegations leveled against the accused and material placed before the Court disclose grave suspicion against the accused which has not been properly explained and hence prima facie case under Section 302 RPC is made out against the accused Nirmal Singh and consequently charges have been framed against the accused.
According to police on 1st June 2014 at about 12:30 PM complainants’ father Bua Ditta was attacked by accused Nirmal Singh at Smailpur Nagbani, Tehsil Jammu which led to victim’s death. On basis of the complaint, FIR No.207/2014 for offence under Sections 302/341 RPC was registered in Police Station Domana, Jammu. JNF
