JAMMU: Principal Sessions Judge Jammu R.S Jain on Saturday discharged Ramesh Kumar, son of Manga Ram, resident of House No. 4, Rehari Colony Jammu who was Challaned by the police in NDPS Case.
According to police, on 19th June, 2014 at Trikutanagar, Jammu, the police recovered 100 bottles of Corex, 715 tablets of Anzilum OS, 240 tablets of Corisoma and 216 capsules of Spavas Parivon from possession of Ramesh Kumar. Accordingly, accused was arrested in FIR 114/2014 of Police Station Bahu Fort under Sections 8/21/22 NDPS Act.
Justice Jain observed that there is no evidence on record more so the report of the public analyst to show that the articles allegedly recovered from the possession of accused person contained drugs which violates the provisions of NDPS Act. From the date of filing the Challan till date, prosecution has been unable to file the report of the FSL which would show that the articles seized from possession of accused contained drugs so as to make out a prima facie case against the accused for offences under the NDPS Act and thus the allegations against the accused are based on conjectures and surmises which have no basis. Justice Jain, therefore discharged accused Ramesh Kumar for the offence under Sections 8/21/22 NDPS Act. JNF
