Court denies pre-arrest bail to fraudster duo

JAMMU: Principal Sessions Judge Jammu R.S Jain rejected the pre-arrest bail application of two accused namely Tanvir Hussain and Zakir Hussain who duped people on assurance of providing employment.
According to police, complainant Parmesh Kumar, a resident of Tehsil Majalta filed a complaint in Police Station Miran Sahib on 17th January 2015 claiming that Abdul Majid Shah, resident of Kotli Mian Fateh, Tehsil R.S Pura, who came in his contact for curing his ailing father, took Rs. 2 lakh on the assurance that he will provide government job to complainant.
He further alleged that after 5/6 months Abdul Majid visited his house and again demanded Rs. 1.50 lakh for providing appointment orders. “Neither the appointment order nor the money was returned”, he further alleged in the complaint.
It has been further averred in the police report that on 16th January, 2015, complainant went to the house of Abdul Majid and that Abdul Majid along with his sons armed with weapons came and attacked the complainant and he ran away to save his life. In this report FIR No.9/2015 for offence under Sections 420, 504 and 506 RPC/4/25 Arms Act was registered in Police Station Miran Sahib and during investigation, the Investigation Officer took the statements of witnesses and it came out that Abdul Majid posing a saintly person gives false assurances to people that he would get them government jobs on payment of money and during interrogation, Abdul Majid acknowledged that he has taken money from 42 persons on assurance of getting them jobs and in this racket, Abdul Sheikh, Mohammad Aslam Bhat, Mohammad Yasin, Ghulam Mohiudin, Bashir Ahmed Bhat and Moneer Ahmed were also involved. “However, they cannot be traced out”, the report said. The report also said that Abdul Majid Shah, Zakir Hussain Shah and Tanvir Hussain have got interim anticipatory bail and not attending the investigation besides weapons and money is yet to be recovered from accused.
Principal Sessions Judge Jammu R.S Jain after hearing both the sides observed that the allegations coming against the accused persons in the police report is heinous and denied pre-arrest bail to the accused persons. JNF
