Court denies bail in rape case

JAMMU: 3rd Additional Sessions Judge Jammu Kishore Kumar Thursday rejected the bail application of one Mohd Farooq, son of Mohd Dar, resident of Malhar, Tehsil Billawar, District Kathua who was allegedly involved in rape case.
According to the police case on 15th May, 2015, complainant namely mother of prosecutrix made a written complaint in the police station Domana interallia alleging that on 11.05.2015 her daughter name withheld had gone to her maternal uncle and later on she came to know that her daughter had not reached there. In this regard, a missing report has already been lodged with the Police Station and thereafter from reliable sources it came to know that prosecutrix had been enticed and kidnapped by one Mohd Farooq S/o Ghulam Mohd R/o Malhar, Tehsil Billawar and taken her to an unknown place. On this report FIR NO. 165/2015 for the commission of offence under section 366 RPC was lodged in the police station.During investigation it emerged that accused Mohd. Farooq took the prosecutrix Kanpur (UP) by inducement and enticement and wrongfully confined her in a room and committed rape upon her repeatedly .The accused pretended him to be a hindu boy namely Rahul to the prosecutrix and developed intimacy with her thereafter took her to a village at Kanpur and confined in a room. After investigation, offences under sections 376, 366, 343 RPC have been established against the accused.
3rd Additional Sessions Judge Jammu Mr. Kishore Kumar observed that offences allegedly committed by the accused carry punishment of life imprisonment and serious in nature, it is considered to be a menace and threat to the society as a whole.
“The accused person, resorted to such activities which demean the psychology development of a woman.” “The crime of rape is not only a crime against a person/or woman which it is a crime against the whole society. No doubt personal liberty guaranteed to the accused is undoubtedly his valuable right under Article 21 of the Constitution but the same can be refused to the accused in accordance with the procedure established under law. Keeping in view the afore-mentioned facts and circumstances of the case, the nature and seriousness of the charge, the bail application is rejected.
