SAMBA: Principal Sessions Judge, Samba M.L Manhas on Thursday rejected bail applications of Mudassar Ahmed Bhat, Ishfaq Ahmed Ganai and Shahbaz Mohi-ud-Din for their alleged involvement in narco smuggling.
According to police, the accused persons were arrested in case FIR No. 02/2017 under Sections 8, 21 and 22 NDPS Act, as large quantity of Spasmoproxy Van Spas Plus and capsules have been recovered and seized from their possession by Police Station, Bari Brahmana.
After hearing Public Prosecutor Bhupinder Singh Charak appearing for the State, the Court observed that it can’t lose sight of the fact that the menace of the crime of smuggling of contraband drugs is on rise. The perpetrators of the crime who are destroying the society and younger generations rendering them incapacitated by falling prey to drug abuse, must be dealt with iron hands, the Court added.
The Court further observed that showing leniency in such matters would be really a case of misplaced sympathy. The criminal acts of accused persons operating in a manner as the smugglers of contraband capsules is destructive and is aimed at destroying the social fiber of the country, therefore, curtailment of their liberties is reasonable and rigor contained under Section 37 is applicable. The granting of bails to the applicants would lead to the danger of the course of justice being thwarted, the Court stressed.
With these observations, the Court rejected bail applications of the aforementioned accused persons.
