Court denies bail in rape case

BUDGAM: Chief Judicial Magistrate Budgam, Kamlesh Pandita rejected the bail application of one Imtiyaz Ahmad Shah who was arrested in rape case by Khansahib Police Station.
According to the police, on the complaint lodged by the father of the prosecutrix on June 12, 2015, an FIR vide No. 40/2015 for the commission of offence under Sections 366, 376 and 506 RPC was registered that his 15 years old daughter has been abducted by the accused person.
During the course of investigation, police recovered the girl and recorded her statement under Section 164-A CrPC. Consequently, the accused was arrested.
The CJM Budgam after hearing both the sides observed that the offence alleged to have been committed by the accused person is heinous and considered against the society at large. Court further observed that rape leaves a permanent scar on the life of the victim and it becomes horrendous for the victim of the rape to lead a dignified and well respectable life in the society. With these observations Court dismissed the bail application. JNF
