CJM orders probe into assault on animal activist

JAMMU: Chief Judicial Magistrate (CJM) Jammu Ashwani Sharma directed the SHO Police Station Janipur Jammu under Section 156(3) CrPC to investigate and report compliance on or before next date with regard to the complaint of an animal activist who was allegedly assaulted on April 5, 2017 by Dr. Sagar Gadage, Incharge SPCA, Roop Nagar (Near School for Blinds), Jammu and his two staff members.
The court directions were passed in a complaint filed by Devinder Kaur Madaan alias Rumpy Madaan, Chairperson SAVE an NGO working for the welfare of animals.
In the complaint it was alleged that the complainant on April, 5, 2017 as Animal Welfare Officer had gone to check the dogs being sterilised at Animal Care Centre, Roop Nagar, Jammu run by Dr. Sagar Gadage and his staff. The aforesaid doctor and his staff assaulted the complainant and almost broke the finger of complainant and nails were torn because of the injuries caused. Two of the staff members were drunk on duty. The complainant was accompanied by Advocate Vishal Khajuria and her driver was also there. Both of them saved the complainant from the clutches of the aforementioned persons, otherwise they could have outraged her modesty.
It is further alleged in the complaint that matter was reported in writing by the complainant to the Police Station, Janipur, Jammu for lodging an FIR against Dr. Sagar Gadage and his staff but no formal case/FIR was registered but only a report was entered in the daily dairy and the complainant was referred for medical examination to Government Hospital, Sarwal, Jammu where vide MLC No.2251 she was examined by the doctors. Since no action was initiated towards the registration of the FIR by the Police Station, Janipur, Jammu as such the complainant approached the SSP, Jammu by virtue of her written request dated July 8, 2017 wherein the complainant apprised the senior police officer about the non-registration of FIR by the Police Station Janipur and sought his intervention in the matter. The complainant further alleged that even the SSP Jammu did not take any action in the matter and resultantly she invoked the powers under Section 156(3) CrPC by approaching the Court of Chief Judicial Magistrate, Jammu.
After considering the submissions of the complainant CJM Jammu Ashwani Sharma directed the SHO Police Station Janipur Jammu under Section 156(3) CrPC to investigate and report compliance on or before next date i.e. August 26, 2017.
