JAMMU: A Division Bench of State High Court comprising Justice Hasnain Masoodi and Justice Janak Raj Kotwal on Tuesday directed General Administration Department to file Action Taken Report (ATR) in Chatta-Sunjwan land scam, with regard to enquiry report submitted by the then Divisional Commissioner Jammu Shantmanu, before 10th June.
The direction came in response to Public Interest Litigation (PIL) filed by S.K Bhalla against allegedly hushing-up of Chatta-Sunjwan land scam.
Advocate Sheikh Shakeel Ahmed with Advocate Suraj Singh appeared for the PIL, senior AAG Seema Shekhar appeared for the State, senior Advocate L.K Sharma represented SRK Associates, Advocate Adarsh Sharma appeared for JDA and Advocate Rahul Pant represented the then Naib Tehsildar.
Advocate S.S Ahmed submitted that pursuant to the last order of the Court, the petitioner was supposed to file a fresh application seeking impleadment of the persons in whose favour the land was transferred. He further submitted that the beneficiary of the illegal transfer of the land has already been arrayed as respondent and thus there is no need to file the fresh application. Upon this Division Bench recorded the submission of counsel for the petitioner.
Advocate Ahmed further submitted that then Divisional Commissioner Jammu Shantmanu in his enquiry report has established that land measuring 20 Kanals comprised in Khasra No. 1442 was illegally sold by tampering the revenue records and no action has been taken against the arraying officials and the beneficiary. He further submitted that Action Taken Report be summoned from GAD which had ordered the holding of enquiry into the matter.JNF
