JAMMU: Principal Sessions Poonch Jaffer Hussain Beigh on Friday awarded 10 years rigorous imprisonment (RI) and a fine Rs 10,000 each to two teachers namely Shahzad Alam, son of Mohammad Alam and Ghulam Mustafa, son of Mureed Hussain, both, residents of Village Fazlabad and acquitted Mohd Ayub as prosecution has not proved against him.
According to the police a report was lodged by Shafeeq Ahmed on behalf of the complainant, Nasib-Ullah on 17th October 2007 against the accused Master Mohd Ayoub, Shahzad Manhas and Ghulam Mustafa Manhas with averments that the complainant, employee of PHE Department, is the resident of Fazlabad, whose daughter Rizwana Kouser, a student of class 8th and another girl Iram Sabah, daughter of Ghulam Ahmed, a student of class 6th of Government Middle School Kote, at about 12 O’ Clock at day time were sent by the accused Master Mohd Ayoub to his house on pretext to bring Arrival Register where the accused Mohd Ayoub along with the other two accused persons namely Shahzad Alam and Ghulam Mustafa were waiting, took the girls into the rooms with the intention of committing rape. The girls seeing the situation raised voice which attracted neighbourers, namely, Shahzad and Zahir and rescued them.
Action under law has been sought against the accused persons. On this FIR No.152 of the year 2007 for commission of offence u/s 342 RPC stood registered in Police Station Surankote with which the investigation of the case started. The complainant took both the prosecutrix to the Court of Judicial Magistrate Surankote where the statements of both the prosecutrix were recorded under section 164 CrPC and after completion of investigation.
Principal Sessions Judge Poonch Jaffer Hussain Beigh after hearing both the sides sentenced accused, namely, Shahzad Alam and Ghulam Mustafa to undergo rigorous imprisonment for ten years and to pay a fine of Rs.10,000/- and in default of payment of fine shall further undergo imprisonment of like nature for 6 months for the commission of offence under section 376(1) RPC and to undergo rigorous imprisonment for six months and to pay a fine of Rs.500/- and in default of payment of fine shall further undergo imprisonment of like nature for two months for the commission of offence under section 342 RPC.
