Bank cashier acquitted in fake currency case

JAMMU: Principal Sessions Judge Poonch Jaffer Hussain Beigh has acquitted Ali Mohammad, son of Tasadaq Hussain, resident of Draba Tehsil Surankote, District Poonch, a bank cashier who was facing charge of giving fake currency notes for salary to police official.
According to the police case on 13th January, 2009 at a complainant was lodged by Sgc. No.287/AP before Police Station Surankote through proper channel with averments therein that while disbursing the salary for the month of November/December 2008 on 7th January, 2009 by J and K Bank Draba to the tune of Rs.19,000 out of which 14 currency notes of Rs. 500 each amounting to Rs. 7000 were fake. He has further narrated that Kasturi Lal No.135/9th Bn and Munir Khan Sgc. No.156/9th Bn are the witnesses in whose presence he withdrew his salary.
On the basis of this report FIR No.09/2009 for offence under Sections 489-B and 489-C RPC was registered at Police Station Surankote.
The investigation of the case was conducted by ASI Ali Mohd Mir who took into possession the fake currency notes, prepared the site plan, seized the drawal form from J&K Bank Branch Draba, recorded the statements of the witnesses under section 161 Cr.PC, sent the alleged currency notes for FSL after getting them resealed and after completion of investigation established offences under section 489-B and 489-C RPC against the accused Ali Mohd who being the Cashier of J&K Bank Draba has found to have handed over the 14 fake currency notes of Rs. 500 each of an amount of Rs. 7000 to the complainant at the time of withdrawal of the pay.
Principal Sessions Judge Poonch Jaffer Hussain Beigh observed that, “I have no hesitation to hold that the accused did not possess those currency notes which has been produced by PW1 before J&K Bank Surankote. In view of this I am of the firm opinion to hold that the prosecution has failed to prove its case against the accused under section 489-B and 489-C of RPC. Accordingly the Challan is dismissed and the accused is acquitted. He stands released from his bail bond. The fake currency notes shall be destroyed after the period of appeal. JNF
