Bail denied in rape case

JAMMU: CJM Reasi Kamlesh Pandita rejected the bail application of one Mohammad Asraf, son of Saif Ullah who was allegedly involved in rape case.
The CJM Reasi after hearing both the sides observed that such offences which the accused persons allegedly commit are not only lamentable but also deplorable. “Rape is a crime against one’s mind, psyche and reputation. Rape leaves the permanent scar on the life of the victim and it became horrendous for the victim of rape to lead a dignified and well respected life in the society. It is very unfortunate that there is a high increase in the rape instances and these ravenous maniacs are not even sparing the girls of a very tender age”, the court observed.
“While dealing with the bail applications, no roving enquiry is required but prima facie evidence and gravity of the offences shall be taken into account. Whether the offences alleged to have been committed by the accused persons are sustainable or not, same exercise can be done by the court at the time of charge/discharge”, the court added. Consequently, the bail application of the accused person was rejected.
