Shankutla-Janipur fly-over: DB seeks J&KERA records

JAMMU: A Division Bench of State High Court comprising Chief Justice M.M Kumar and Justice Dhiraj Singh Thakur directed Managing Director J and K ERA to appear along with record in regards to fly-over project from Shakuntla Chowk-Balwinder Chowk-Amphalla connecting Jail road and New Plot Janipur road.
A Public Interest Litigation (PIL) filed by Citizen Forum had leveled the charges the project conceived in 2008 has been abandoned for some extraneous reasons.
Senior Advocate S.S. Lehar with Advocate Aditya Sharma appeared for the PIL whereas AAG Seema Shekhar appeared for the State.
According the objections filed by J and KERA, it has not been stated that the aforesaid project has been abandoned. The impression created is that it has either been deferred or it is required to be reviewed as per the mobility plan submitted by RITES. There is no clear stand with regard to the loan agreement signed in the year 2008 with the Asian Development Bank (ADB) and the State. Likewise, in para 2 of the objections filed on behalf of the PWD (R&B) an impression has been created that the project has been abandoned and fresh recommendations for construction of monorail made by RITES are under consideration.
After going through the objections, Division Bench observed that in order to know whether the fly-over project of 2008 still subsists or it has been abandoned, a perusal of the record would be necessary and directed the production of record and sought assistance of Managing Director, J and KERA and observed that Managing Director, J and K ERA appear along with the record on next date of hearing.
