Bail denied to 65-yr-old in kidnapping, rape case

JAMMU: Judicial Magistrate Samba Junaid Imtiaz Mir rejected the bail application of one Ghulam Nabi (65 years), who was allegedly involved in kidnapping and rape case.
Court after hearing senior PO Kuldeep Bhat appearing for the State observed that accused is alleged to have abducted the prosecutrix with the assistance of some other individuals after which she has been confined at the house of the accused where he repeatedly committed rape.
Taking into account the statement of the prosecutrix recorded under Section 164 CrPC, perusal of the CD file and available medical records, the court observed that the material prima facie is sufficient to point towards the guilt of the accused and added that purport of Section 497 (C) provides that bail has to be refused.
The court observed that the offence under which the accused prima facie from the CD file appears to be involved is very serious in nature having immense social implications that shake the social fabric to the very core, therefore the bail application merits rejection. It was also observed that from the CD file it is revealed that the investigation is still underway with FSL report still to be procured and statements of important witnesses still to be recorded meaning thereby that the accused at this crucial stage can’t be given the concession of bail. With these observations court rejected the bail application.
