Assault on RTI activist: Court orders probe against former Minister’s son, others

JAMMU: In a complaint filed by one RTI activist Dr Rehmatullah Khora, the Court of Sub Judge Jammu after hearing Advocates A.K Sawhney, Aseem Sawhney with Neeraj Singh, Ila Sharma, Utkarsh Pathanai and Shiv Dev Thakur appearing for complainant has directed investigation under Section 156 (3) CrPC, which can only be done after lodging of an FIR.
Kusum Pandita Sub-Judge Jammu has passed this order and directed the SHO Police Station Trikuta Nagar Jammu to investigate under 156(3) CrPC, therefore the SHO would be duty bound to register an FIR now.
Advocate Aseem Sawhney while making submissions stated before the Court that Hillal Rather is a powerful and influential person being the Director/ MD of Simula and Paradise Avenue and is also son of former Finance Minister of J&K A R Rather, while other accused are Ghulam Mohd Bhat, Dr Rizwan Rahim Dar, D. Wadhera, Tarsem Singh Ja1mwal and Mudassir Ahmed are all well connected people. He also submitted that Manzoor Ahmed Wani is Vice President of National Conference Kashmir and all these accused with common intention had kidnapped, abducted and assaulted the complainant Dr Rehmatullah Khora.
In the complaint it has been alleged that complainant went with the complaint to SHO Police Station Trikuta Nagar and also moved complaint before the SSP Jammu but since the accused are highly influential people the police has failed to register the FIR under law, since cognizable offences have been spelled out. The complainant has alleged that he was wrongfully confined by the accused for 8 hours at the Paradise Avenue office and beaten up because he had obtained certain vital and incriminating evidences against their company and was making investigations into the scam of the said accused and their company.
