ACB restrained from presenting Challan against Ex-Tehsildar Bahu

JAMMU: In a petition filed by Rohit Sharma, the then Tehsildar Bahu who was allegedly caught red-handed by Anti-Corruption Bureau (ACB), Jammu & Kashmir and Ladakh High Court after hearing senior Adv Sunil Sethi with Adv Parimoksh Seth restrained ACB to file Charge-sheet.
As per petition, the petitioner Rohit Sharma is aggrieved of a motivated and dramatized trap laid by ACB, Rajouri. It has been further requested that while serving as Tehsildar Bahu, petitioner has been wrongly and falsely implicated in FIR 02/22 registered with Police Station ACB Rajouri (camp Jammu) under section 7 of the Prevention of Corruption Act, 1988 with allegations that the petitioner has demanded illegal gratification/ bribe, which has been recovered from his possession.
Rohit Sharma, the petitioner was arrested in aforesaid FIR and later on granted bail by the High Court. As per petition, the alleged trap proceedings have taken place in premises of the office of Tehsildar, Bahu Jammu and building was having CCTV coverage, in possession of the owner of building. The CCTV footage which is in the public domain clearly indicates that whole trap was forged and was laid down to falsely implicate the petitioner. A pen drive in original, containing 4 CCTV footage clips of day, depicting alleged trap proceedings, was also presented.
Justice Javed Iqbal Wani after hearing Sr. Adv Sunil Sethi with Adv Parimoksh Seth for the petitioner whereas Sr. AAG Monika Kohli for the UT, issued notice to the respondents, returnable within three weeks.
Meanwhile, subject to objections and till next date of hearing before the Bench, the investigation in impugned FIR 02/22 dated November 14, 2022 shall proceed, however on completion of investigation, in the event, charge-sheet is contemplated to be filed and same shall await orders of the Court.
