Illegal allotment of prime custodian land, encroachment

JAMMU: The Anti Corruption Bureau (ACB), Srinagar has booked Majid Khalil Ahmad Drabu, IAS, Controller Legal Metrology, his brother-in-law Miwaiz Umar Farooq Hurriyat leader and others for fraudulently and dishonestly resorting to corrupt practices for encroaching and getting allotted 7 Kanal 19 Marlas prime custodian land, worth crores in their names at Nageen ,Srinagar for just Rs 6 lakhs.
According to FIR 10/24, a preliminary enquiry (PE No.22/2019) was conducted into allegations, which revealed that one Dil Rafiqa, wife of Dr. Abdul Majid Sofi, resident of Hazaratbal, Srinagar was conferred undue benefit by the Custodian Department by illegal allotment of evacuee land without obtaining government sanction and without having open auction in violation to the standing provisions.
During the course of preliminary enquiry, it was found that evacuees land belonging to Imam-u-Din, located at Saderbal Hazratbal, falling under survey number 640 has been allotted in favour of some individuals, including Dil Rafiqa, in gross violation of rules and regulations governing the subject.
Moreover, out of the mentioned evacuees land, belonging to Imam-u-din, land measuring 07 Kanal 19 Marias 97 sqft has been encroached upon by the allottees Dil Rafiqa, Majid Khalil Ahmad Drabu, IAS, son of Saif-Ud-Din Ahmad Drabu, resident of Qammerwari. Srinagar, Mohd. Amin Khan, son of Gh. Nabi Khan, resident of Saderbal, Srinagar, Ab. Majeed Bhat, son of Mohd Abdullah Bhat, resident of Saderbal, Srinagar, Qazi Bilal Ahmad, son of Qazi Noor Din, resident of Nageen, Srinagar and Hurriyat leader Moulvi Umar Farooq, son of Late Mohammad Farooq, resident of Nageen, Srinagar.
The enquiry has revealed that the officers and officials of the Custodian Department, in league with the officials of Revenue Department and beneficiary allottees, dishonestly and fraudulently, by resorting to corrupt practices, in furtherance of a conspiracy, by abuse of their official positions, made allotments of evacuee land in violation to the prevailing rules and norms and also for their ulterior motives, maintained criminal silence by not taking action against the encroachers well in time thereby bestowing undue benefit upon themselves and the beneficiary allottees/encroachers with corresponding wrongful loss to the state exchequer.
The omissions and commissions on the part of officers/officials of the Custodian Department Kashmir. Revenue Department, the beneficiaries and others constitute offences punishable under section 5(1) (d) read with section 5(2) of J&K Prevention of Corruption Act Svt. 2006 and section 120-RPC. Accordingly FIR. 10/2024 has been registered in ACB Srinagar and investigation entrusted to DySP Rameez Raja.
