Abetment to suicide: Daughter-in-law’s bail rejected

JAMMU: Excise Magistrate Jammu Umesh Sharma rejected bail plea of one Aarti Khanna, daughter-in-law in abetment to suicide case.
Excise Magistrate Jammu Umesh Sharma after hearing Adv Sandeep Bhat for applicant whereas APP Yogesh Bamba for the J&K UT observed that investigation of the case is in progress and the accused was arrested just few days back. Further, many other material aspects of the case are yet to be investigated and in case the accused is enlarged on bail, there is every apprehension that she may temper with the evidence and may also flee away from clutches of law. “I have considered the prayer of the accused for bail in the light of the various circumstances stated above and in view of the facts and circumstances of the case, I am of the considered view that a strong prima-fascia has been made out against the accused. No doubt personal liberty of the accused is her constitutional guarantee but the same can be refused in accordance with the procedure established by law and is required to be balanced with the impact of the offence upon the society,” the Court observed and rejected the bail application.
As per details, Police Station Janipur received an information that two bodies are lying in suspicious circumstances in a house situated at Janipur Colony, Jammu. An inquest under section 174 of CrPC started and during the probe, the dead bodies were identified as Shashi Paul (56) and his wife Kiran (54).
The statements of witnesses conversant with facts and circumstances of the case were recorded. A suicide note allegedly written by deceased Shashi Paul was also recovered from the spot and the same was forwarded to FSL for expert opinion. The couple Shashi Paul and wife Kiran), had ended their lives allegedly by consuming some poisonous substance and accordingly expert opinion was also obtained. The post mortem report was also made part of the file. On basis of the report received from FSL, it was established that suicide note was written by Shashi Paul. On the basis of probe conducted, it was found by the police that the applicant/accused, who happened to be daughter-in-law of deceased couple, had abetted their suicide. Finally, on the basis of inquest conducted, FIR 71/2022 was registered at Police Station Janipur against accused Aarti Khanna under section 306 of IPC and she was arrested on July 6, 2022 and is presently on judicial remand.
