Advocate Wazir shifted to AIIMS on Court direction

JAMMU: In a mysterious disappearance of Advocate cum Sarpanch Raman Wazir, Justice Tashi Rabstan of J&K High Court after hearing battery of lawyers, directed Principal GMC to shift Advocate Raman Wazir at AIIMS, New Delhi.
Justice Tashi further directed IGP, Jammu to enquire how Advocate Raman Wazir has disappeared; under which circumstances he reached Chandigarh and what happened during the period he remained untraced.
Besides checking the CCTVs installed en route Chandigarh from the spot where Advocate Raman Wazir got missing, IGP is further directed to check the recording of CCTVs installed in and around Shop No.26, Sector 11, Chandigarh to know whether it was Advocate Raman Wazir or somebody else who had accessed his e-mail, the reference of which has been given in the status report as well as in the media.
During investigation if the police feel to interrogate any person, the police would be at liberty to interrogate any such person whosoever influential he may be and take action strictly in accordance with law.
Justice Tashi Rabstan also directed DGP J&K to provide full-proof security to the patient en route till he is admitted at AIIMS, New Delhi. DGP is also directed to provide the security to the family members of Raman Wazir at Jammu. However, security to family members shall depend upon the outcome of investigation.
When the petition came-up for hearing Principal, Government Medical College, Jammu made a statement in the open Court that although the medical tests conducted upon Advocate Raman Wazir appeared to be normal, yet neurologically he is in a semi-conscious state and that as yet he is not fit for making a statement.
He, however, stated that he had a brief interaction with the patient, namely, Raman Wazir, with gestures and which he gathered from his gestures is that the patient has pain in his legs, abdomen and head and that he does not know how he reached Chandigarh. He further stated that no apparent injury has been found on his body. The Principal further stated that Poison Detection Facility is not available at Jammu, therefore, in his opinion the patient requires to be referred to AIIMS at New Delhi today itself.
Justice Tabstan Rabstan observed that since it has been advised to refer the patient to AIIMS at New Delhi, Medical Superintendent, AIMS, New Delhi is impleaded as party respondent to the petition. Registry to, accordingly, update the cause title and further observed that since the missing Advocate Raman Wazir has been recovered by the Police, the purpose of present habeas corpus has been achieved and the SIT is, accordingly, dissolved.
However, keeping in view the concern of family members of Advocate Raman Wazir and the Members of the Bar that there is some foul play in his mysterious disappearance, the instant petition is disposed of with the directions that IGP Jammu to enquire how Advocate Raman Wazir has disappeared.
Justice Tashi Rabstan also directed Incharge, SIT to hand over the complete record of investigation to the concerned police forthwith, which will start to investigate the whole episode from today itself.
Court also directed Principal, Government Medical College, Jammu is strictly to properly conduct the medical examination of Advocate Raman Wazir till he is admitted at Jammu. Any lapse on the part of investigating agency or Medical Board would be viewed very seriously.
Court further said that upon referral of Advocate Raman Wazir to AIIMS at New Delhi, it would be upto the Medical Board to advise how he has to be shifted to New Delhi, either in an Intensive Care Ambulance or Air Ambulance. However, in both the situations a Senior Doctor along with required medical staff shall accompany the patient till he is admitted at AIIMS and DGP is directed to provide full-proof security to the patient en route till he is admitted at AIIMS, New Delhi.
DGP is also directed to provide the security to the family members of Raman Wazir at Jammu. However, security to family members shall depend upon the outcome of investigation.
Court further said that State Government in consultation with the Union of India, is directed to provide full security to Advocate Raman Wazir at AIIMS, New Delhi. Keeping in view the statement of Principal, Government Medical College, Jammu, Medical Superintendent, AIIMS is directed to conduct thorough medical examination of the patient and to verify whether the missing Advocate had been administered any type of intoxicant/drug.
