Katra demolitions: DB directs respondents to file reply
JAMMU: In a petition filed by Jaspinder Singh challenging the constitutional validity of an Act passed by the State Legislative Assembly of Jammu and Kashmir known as Jammu and Kashmir Civic Laws (Special Provision) Act, 2014. The main challenge to the act is based on the argument that the Act does not take away the base of any judgment, order or direction issued by this Court but the legislature is acting as an appellate authority.
In the petition, petitioner referred various judgments of Supreme Court including Keshvananda Bharati vs. State of Kerala, Division Bench of State High Court Comprising Chief Justice M.M Kumar and Justice Dhiraj Singh Thakur after hearing Advocate Ajay Sharma and Advocate Parag Sharma for the petitioner, directed State to file reply before the next date of hearing failing which matter shall be heard without reply.
In the contempt plea against Deputy Commissioner Reasi in much Public Interest Litigation regarding illegal constructions in Katra, Division Bench of state High Court comprising Chief Justice M.M Kumar and Justice Dhiraj Singh Thakur, directed respondent to file objections before the next date of hearing because the Deputy Commissioner Reasi is state to be busy in arranging help and aid for the poor people on account of unprecedented situation created by floods.
