Tis Hazari Court rejects bail applications of Sudarshan Wazir

NEW DELHI: The Additional Session Judge Tis Hazari Court Delhi in his judgment has dismissed the following two bail applications of accused Sudarshan Singh Wazir in SC No 216/2022 State v/s Harmeet Singh and Ors pertaining to PS Moti Nagar FIR No 557/2021 under section 302/201/120-B/34 IPC and 25/27 Arms Act. The bail applications under sec 167 Cr PC seeking grant of default bail and application u/s 439 Cr.P.C of accused seeking regular bail have been dismissed on the grounds given against each in the succeeding paragraphs.
The petition under section 167 Cr. PC was dismissed by the Court as the accused did not have right to default bail.
In the case of petition for regular bail under section 439 Cr. PC the court heard the counsel for the accused as well as the prosecution by giving a careful consideration to the submission of both sides and said that the most important aspect while considering application for regular bail under section 439 Cr PC are the gravity and seriousness of the offence as well as the severity of the punishment. The Additional Session Judge of the court held that in view of the overall facts and circumstances I am of the considered opinion that at this stage no ground for bail is made out. Accordingly the bail application under Section 439 Cr PC also stands dismissed.
