DB directs authorities to place on record steps taken for constitution of State Commission for protection of child rights

JAMMU: A Division Bench of Jammu & Kashmir and Ladakh High Court (Srinagar Wing) comprising Chief Justice N. Kotishwar Singh and Justice Atul Shreedharan directed authorities to place on record the steps taken for constitution of State Commission for protection of child rights.
When the PIL came-up for hearing, DB observed that Section 44 of The Protection of Children from Sexual Offences Act, 2012 mandates monitoring of effective implementation of the provisions of the aforesaid Act by the concerned State Commission for protection of child rights. During the course of hearing it has been submitted that no such Commission has been constituted in the UT of Jammu and Kashmir as well as in UT of Ladakh. DB observed that considering the statutory role assigned to the Commission for effective implementation of the Act, non-constitution would be a serious lapse on the part of the authorities concerned. DB observed that before we issue specific directions in this regard, we require authorities to place on record the steps taken for constitution of this Commission.
