Delhi-based thief denied bail

JAMMU: Sub-Judge Katra Sandeep Gandotra on Monday rejected the bail application of one Sonu Sanu, son of Mohammad Umar, resident of E-1 405, Nand Nagri, Delhi, who was allegedly involved in theft at Shri Mata Vaishno Devi Shrine Bhawan.
According to police report, the complainant Parmod Verma, son of Isher Dass Verma, resident of Mahanpur in Kathua on 24th May 2017 moved an application in Police Station, Bhawan stating that a person ran away from Bathing Ghat area after picking up his bag
containing android cell phone and Rs. 23,800 besides clothes when he was taking bath.
Despite a hot chase, he managed to escape on the track. On the receipt of this complaint, FIR No. 05/2017 for offence under Section 379 RPC was registered against the accused and investigation started.
During the course of investigation, the Investigation Officer (IO) visited the scene of crime and prepared the site plan; recorded the statements of complainant and of witnesses under Section 161 Cr. PC. On 26th May 2017, the IO visited Manokamna Bhawan for investigation and on seeing the police party, saw a person trying to flee. That person was chased and caught and brought to Police Station, Bhawan. On inquiry, he revealed his name as Shamim-ul-Hassan and also disclosed location of his four associates and stolen bag viz. Room No. 102 Chinar Hotel Katra. Upon this, police recovered stolen property and arrested Shamim-ul-Hassan’s four accomplices namely Mohammad Shakeel, Sonu Mohammad, Mohammad Rishan, Mohammad Yashu. From IO’s investigation, offence under Section 379 RPC was proved against the accused.
Sub-Judge Katra after hearing both the sides observed that bail at this stage would scuttle the investigation and the accused may tamper with the evidence and otherwise also the bail at
this stage would not be in public interest, which is one of paramount consideration. With these observations court rejected the bail
application.
