Nursing Orderly arrested;Ex-Principal, XEn, BMO among 8 booked

JAMMU: State Vigilance Organization (SVO) on Thursday registered three separate FIRs against former Principal, Government Degree College (GDC) Udhampur, Executive Engineer (XEn) of Irrigation Division, Sonawari, Block Medical Officer (BMO) Kulgam and others for incurring losses of lakhs of rupees to state exchequer by abusing their official positions.
Meanwhile, a nursing orderly working as Assistant Cashier in the office of BMO Kulgam has been booked and arrested for fraudulently transferring / facilitating withdrawals to the tune of Rs.56,76,198. BMO Kulgam and a Senior Assistant are already in Vigilance lockup for their involvement in another FIR registered in 2012.
According to FIR 11/17 registered under section 5 (1) (d) read with 5 (2) J&K P.C Act 2006 against Dr Nutan Kumar Resutra, the then Principal GDC Udhampur, a verification was conducted into the allegations that during his posting as Principal in the year 2010-12, he had spent more than Rs10 lakh on renovation of his quarter in Udhampur College Campus which otherwise falls under the purview of PWD (R&B) as PWD charges rent of all the quarters located inside the College campus on monthly basis.
“Prof Nutan floated quotation for different types of works which were purely technical in nature,” the SVO stated, adding “Instead of executing the work through PWD (R&B), he by misusing his official position, charged higher rates for different types of works and spent Rs 23.13 lakh on 32 minor works which were executed departmentally on the basis of quotations.”
The comparative statements were certified by the committee members in a mechanical manner without any survey or application of mind. Neither the technical sanctions/estimates were obtained nor the bills/vouchers were technically verified. In addition to this, the mandatory service tax has not been deducted from the payments made to the contractors at different occasions. After the allotment of the works to the contractors, the CDRs were not obtained and PWD (R&B) was not consulted for the technical guidance.
Loss to the tune of Rs 3.01,453 on account of excess payment and non deduction of the tax has been caused to the state exchequer, state the SVO. The investigation of the case has been set in motion.
Meanwhile, SVO registered another FIR 9/2017 under section 5(1) (c) (d) read with Section 5(2) J&K P.C. Act Svt. 2006 and Sections 120-B, 109 RPC against the accused persons Abdul Rashid Dar, the then BMO Kulgam (now retired), Mohammad Ashraf Parray the then Senior Assistant presently posted in BMO Office Qazigund and Mukhtiyar Ahmad Khan the then Nursing Orderly, functioning as Assistant Cashier in the office of BMO Kulgam.
In this case, a Nursing Orderly functioning as Assistant Cashier in the office of BMO Kulgam has been arrested for fraudulently transferring / facilitating withdrawals to the tune of Rs.56,76,198 while the then BMO and a senior assistant have been booked. Both these accused are already arrested in FIR 29/2012.
Accused Mukhtiyar Ahmad Khan has been arrested today in for dishonestly and fraudulently transferring / facilitating withdrawals to the tune of Rs.56,76,198 through several beneficiaries. The investigation of the instant case has been taken-up.
According to another FIR (8/17), the SVO has booked Ajaz Hussain Sahaf, the then Executive Engineer Irrigation Division Sumbal Sonawari, Mohammad Ramzan Genaie, the then Head Clerk Irrigation Division Sumbal Sonawari, Tariq Ahmad Khan Senior Assistant, the then Establishment Clerk Irrigation Division Sumbal Sonawari, and Nisar Ahmad Itoo (beneficiary) into the allegations of illegal regularization of said temporarily engaged orderly.
FIR has been registered under sections 5(1) (d) r/w 5(2) P.C Act Svt, 2006, Section 120-B RPC against all these accused persons.
The accused under a well knit conspiracy hatched among themselves have illegally regularized the temporary engaged beneficiary as permanent Orderly by preparing / attesting his service book and have drawn full salary in his favour as that of a regular permanent Orderly since January 2009 thereby conferring wrongful gain in his favour by way of abuse of their official positions against corresponding wrongful loss to the state exchequer.
