Court restrains Jammu Club from filling-up membership

JAMMU: Sub-Registrar Jammu Adnan Syed on Thursday restrained Jammu Club from filling-up the existing vacancies of permanent members in Jammu Club.
The direction came in a suit filed by Vishal Dhar challenging his non-enrollment as permanent member of Jammu Club.
Advocate Vikram Sharma appeared for the plaintiff while Advocate Pranav Kohli represneted the Jammu Club.
Advocate Vikram Sharma asserted that despite fulfilling the requisite eligibility for being a permanent member and fairing well in the introductory meeting/ interview conducted by the Managing Committee of the Jammu Club, the plantiff was denied the enrollment as permanent member without assigning any reason for non-acceptance of his candidature.
He submitted before the Court that Jammu Club was under an obligation to convey the reasons to the applicant why he/she was denied permanent membership particularly in view of the fact that plaintiff has been enrolled as special temporary member by the Jammu Club way back in the year 2007. It was further argued that if an applicant was found deserving and eligible to be a special temporary member of Jammu Club by the Managing Committee of the club, it sans logic and legitimate expectation that his candidature for permanent membership found no merit with the Managing Committee in process initiated for enrollment of permanent members in the year 2017. It was stressed that there is no adverse entry or default of the plaintiff in the 14 years long association of the plaintiff with the club.
While the counsel for the Jammu Club opposed the passing of any interim order, Court after considering the arguments and the material based on record, directed Jammu Club to keep the vacancies of permanent membership available as on today, till the court passes final orders. Consequently, the Court fixed hearing of the case on 20th of March 2017.
