Court denies bail to advocate in rape case

JAMMU: The 3rd Additional Sessions Judge Kishore Kumar on Monday rejected the bail application of one, Advocate Ashfaq Ahmed Khan who was allegedly booked by the police in a rape case.
According to the police, a report was lodged by the victim stating that a person namely Ashfaq Ahmed met her at a house near Tiny Tots School, Sainik Colony, Jammu and raped her. He then threatened her of life if she discloses the matter to anyone. The police registered an FIR No. 105/2016 for the commission of offences under Sections 376, 342 RPC and the investigation was started.
The Additional Public Prosecutor (APP) argued the Advocates are the role model of the society and the accused Advocate has committed a very heinous offence which carries punishment of more than 10 years or upto life imprisonment.
He further said that granting bail to an Advocate will definitely demoralise the prosecution witnesses and the confidence of the public at large will be shattered.
The Court observed that granting the bail in the aforesaid case may shaken the confidence of the society in the criminal judicial system. With these observations, the Court rejected the bail application of the accused lawyer.
