Petition for release of Pak, foreign prisoners SC grants 3 weeks to Centre for filing response

NEW DELHI: A Division Bench of Supreme Court of India comprising Justices J Chelameshwar and Abhay Manohar Sapre granted three weeks to the Union of India to file a detailed reply in connection with the continuous detention of several Pakistani prisoners detained in different jails of India for the last several years with some of them without trial and others without charges framed.
The direction came in response to petition filed by the Panthers Party Chief Patron, Prof. Bhim Singh, Senior Advocate in 2005 with a prayer to release all foreign prisoners, mostly citizens of Pakistan and residents of PoK who have been languishing in different jails in the country since nineties. Singh submitted before the SC, that court directions were not implemented by the Government of J and K as well as by the Union of India on different occasions and without any ground.
Prof. Bhim Singh said that the Supreme Court in 2009 has directed the Union of India and the State Government to ensure that the trials of all the Pakistani accused were concluded within a period of one year. Besides, Singh submitted that all those foreign prisoners (mostly from Pakistan) who have completed more than 15 years in the Indian prisons may be repatriated as they have exhausted their life sentences as has been defined in the Indian Penal Code.
The writ petition by Prof. Bhim Singh has urged the Supreme Court for the repatriation of prisoners including Ghulam Nabi, son of Fazal Din, Ashiq Ali, son of Warand Ali, Javed Hussain Shah son of Gulam Hussain Shah, Abdul Hayee Mali, son of Mohammad Ajmal Malik, Abdul Rashid Gani, son of Abdul Kadar Sheikh, Abdul Rahi, son of Majid Khan, Mohammad Hussain, son of Nazir Ahmed, Mohammad Mubashir, son of Mohammad Tahir, Shahnawaz Malik, son of Kandar Malik, Dilawar Sain, son of Hasan Sain, Abdul Mateen, son of Hazi Mohammad Yakub, Mohamad Sharif, Khalid Mehmood, son of Mohammad Yusuf, Nazir Khan, son of Hazi Lal Khan, Nasir Mehmood Sdazoy, son of Sakhi Mohammad, Mohammad Javed, son of Mohammad Shafi and Abdul Rahim, son of Majid Khan. Advocates who assisted Prof. Bhim Singh included B.S Billowria, D.K Garg, Ritu Puri and Vijay Pratap Singh.
