Court restrains transactions by Amar Kshatriya Rajput Sabha

JAMMU: The Court of Additional District Judge Jammu Rajesh Sekhri in response to the plea submitted by Pawan Singh Manhas and Anil Dev Singh, has restrained President and Chairman Trustee Shri Amar Kshatriya (Rajput) Sabha Raj Tilak Bhavan Purani Mandi, Jammu (Defendant No 2) for carrying out any commercial or financial transactions or exercise any financial powers in contravention to the provisions of the ‘NIYAMAVALI’ of the Rajput Sabha. The order to this effect was passed on 26th February, 2016.
According to the complaint the plaintiffs have alleged that Defendant No 2 was not elected, selected, appointed or nominated by competent person/authority as per ‘NIYAMAWALI’ therefore his role in the said capacity was not only illegal but against the interst of the Rajput community and all acts done by him are prejudicial to the society in general and Rajput community in particular. The plaintiffs alleged Defendant No 2 since long has been misusing the funds and property of the Rajput Sabha for his personal gains without any authority and mandate of the Sabha. He further alleged that the Defendant No 2 has demolished the Rajput Sabha Head Office and old heritage temple thereby hurting the sentiments and emotions of millions of people belonging to Rajput community, besides setting his eyes on Thakker Sabha at Dogra Hall Jammu for creating shops.
The plaintiffs have sought permanent prohibitory injuction restraining the defendants, their aids, agents or attorney holders from interfering with the affairs of Shree Amar Kshatriya (Rajput) Sabha Jammu and Kashmir by claiming to be president or any other office bearer of the Sabha with further prayers for grant of permanent prohibitory injunction restraining the Defendant No 2 to create any third party interest in properties belonging to Rajput Sabha.
The Additional District Judge after hearing the arguments issued notice to the respondent to show cause as to why the relief prayed for be not granted in favour of applicants. He was directed to file objections before next date of hearing and till then the defendant/non-applicant No 2 temporarily restrained from carrying out any commercial or financial transactions.
The next date of hearing has been fixed as 9th March, 2016.
