JKSRTC cashier gets 15 year jail term in graft case

JAMMU: Special Judge Anticorruption, Jammu Sanjeev Gupta on Wednesday awarded 15 years imprisonment and a fine of Rs. 2,70,000 to the cashier of Jammu & Kashmir State Road Transport Corporation (JKSRTC) Shiv Dev Singh in 20-year-old corruption case.
While deciding six challans produced against the accused, the Court convicted him for two and half years’ imprisonment and a fine of Rs. 45,000 in each corruption case.
According to the Vigilance Organisation Jammu (VOJ), six challans were registered in FIR under Section 5(2) of Prevention of Corruption Act read with Section 120-B RPC against the accused for alleged misappropriation of Rs. 8,70,011 by not depositing GP fund deductions of the employees in the concerned government treasury from 1995 to 2000.
After concluding the investigation, the VOJ filed separate charge sheets (bifurcated year wise) for commission of offences under Sections 5(2) read with 5 (1) (c) of PC Act and 409, 467, 468, 471, 477-A and 201 RPC.
As per the prosecution, the accused embezzled Rs. 1,26,840, Rs.1,04,280, Rs, 2,36,433, Rs. 2,13,078 Rs. 64,170 and Rs. 1,25,210 from year 1995 to 2000, as mentioned in separate challan Nos. 216, 217, 218, 219, 220 and 221 respectively. After hearing CPO Harminder Singh appearing for the State, the Court observed that the accused was dealing with the government property in his capacity as cashier of JKSRTC and was entrusted with the task of depositing the GP fund of the employees in the government treasury for crediting the same in their respective accounts.
The Court further observed that the aforesaid case relates to embezzlement of GP fund contributions of employees of the corporation which was intended to benefit them at the twilight of their lives and thus, sentenced the accused Shiv Dev Singh in each case to suffer simple imprisonment for one year and to pay Rs. 20,000 as fine for the offence punishable under Section 5(1) (c) read with Section 5 (2) of the P.C. Act. In case of default in payment of fine, the accused shall suffer simple imprisonment for one month.
The accused was further sentenced to suffer simple imprisonment for one year and to pay a fine of Rs. 15,000 for the offence under
Section 409 RPC. The accused shall suffer simple imprisonment for one month on failure to pay the fine. He was also sentenced to suffer simple imprisonment for six months and to pay a fine of Rs. 10,000 for the offence under Section 477-A RPC. In case of default in payment of fine, the accused shall suffer simple imprisonment for one month.
