JAMMU: In a big jolt to the State in deadwood case, Justice Alok Aradhe of J&K State High Court on Thursday quashed compulsorily retirement of 21 employees and directed the State to reinstate them with all consequential benefits within a period of one month.
While hearing 21 petitions, out of 25 listed, the Court quashed the government orders of premature retirement of Incharge Chief Engineer Chenab Valley Power Project Kishore Kumar Gupta, KAS officer Babu Ram (posted as Additional Secretary Social Welfare Department at that time), Executive Officer Ravi Kumar, Incharge Naib Tehsildar Baj Singh, Naib Tehsildars Sher Singh and Gian Chand, Assistant Executive Engineer Syed Ikhlaq Hussain, Police Inspector Ghulam Hassan Kamal, Storekeeper Gh. Mohi-ud-Din, Executive Engineer Girdhari Lal, Naib Tehsildar Fida Hussain, Tehsil supply Officers Shabir Ahmed, Taraq Hussain Ganaie and T.P Singh, Tehsildar Mohd Bashir, Assistant Executive Engineer Farid Ahmed Tak, Executive Engineer Sher Mohammad Khan, Patwari Krishan Lal, Senior Assistant Education Department Mumtaz Hussain, Junior Assistant in Custodian General Romesh Chander and Junior Engineer Kurshid Ahmed.
Pertinent to mention here that the Court on Wednesday had quashed the compulsorily retirement order of six employees and had directed the State to reinstate them in service as in the aforesaid case.
After hearing Senior Additional Advocate General (AAG) Seema Shekhar appearing for the State and a battery of lawyers appearing for the petitioners, the Court observed that all other relevant factors which are mentioned even in the norms have not been followed in the aforesaid case.
With this, the number of terminated or prematurely retired employees whose termination orders have been quashed has risen to 34.
The PDP-BJP government, led by Chief Minister Mufti Mohammed Sayeed had prematurely retired and terminated the services of 63 employees in July last year, barely four months after taking over the reins of the administration in the State.
