Sigh of relief for 84-yrs-old in accident case HC directs insurance company to give Rs 8.5 lakh as compensation

JAMMU: Justice Ramalingam Sudhakar of J and K State High Court on Tuesday directed National Insurance Company to pay Rs. 8,56,000 to 84-years-old Karnail Singh.
The Court was hearing a CIMA appeal in which the claimant demanded compensation in the accident case of his son, Ghar Singh.
Justice Ramalingam Sudhakar, while disposing off the appeal, observed that Karnail Singh, son of Late Teja Singh, resident of village Chatta Gujran, Jammu had appeared in person and sought indulgence of the Court to dispose off his appeal and demanded compensation on the death of his son.
The Court observed that the present appeal goes back to year 2012, in which after a round of litigation, grant of relief to the claimant was declined. The Court on Tuesday reversed the decision of the Tribunal and remanded the case for fresh consideration.
The Court further observed the aforementioned accident had taken place on 16th September, 2001 at about 02:00 PM when Ghar Singh, owner of the ill-fated tractor was ploughing his field at Najwal with his tractor bearing Chassis No. BSM285097 and Engine No. MXC289056. The tractor hit some explosive substance on the land and caught fire, thereby, causing death of Ghar Singh. The adopted father of deceased Ghar Singh was now seeking compensation in the case.
