ALC category seat: HC directs BOPEE to admit petitioner in MBBS

JAMMU: Justice Tashi Rabstan of J&K State High Court on Friday directed J&K Board of Professional Entrance Examinations (BOPEE) to give MBBS seat to petitioner, Kamal Bharti under Actual Line of Control (ALC) female category.
Justice Tashi Rabstan was hearing a petition filed by Kamal Bharti, in which, she claimed to have applied for Common Entrance Test (CET-II), 2016 under ALC category.
The petitioner further claimed that she had appeared for CET on 31st July, 2016 and after the declaration of result, she was placed at 7th rank under ALC category.
But when she appeared for counseling on 7th August, 2016, she was allotted BDS seat in Indira Gandhi Government Dental College, Jammu, despite the fact that BOPEE had kept an MBBS seat reserved for ALC female candidate.
It was also submitted that on 25th August, 2016, another respondent Tanisha Manhas was also called for counseling for selection in MBBS course.
The petition further stated that, on inquiry, it was found that Tanisha Manhas was not eligible to get admission because she had failed to produce the relevant certificate at the time of submission of her application form but she had approached the Court by way of writ petition considering her candidature under ALC category and had also obtained some interim direction by the Court. The petitioner, Kamal Bharti claimed that while Tanisha Manhas was found ineligible to be considered under ALC category. Therefore, she being next in order of merit (Rank 7) is entitled to her admission in MBBS course for the session 2016.
