JAMMU: In a petition filed by Dr. Sujata Sharma challenging the posting of Dr. Poonam Mahajan who is far junior to her and posted as State Tuberculosis Officer whereas she is posted as District Tuberculosis Officer, the High Court stayed the impugned order till next date of hearing before the Bench.
Appearing for the petitioner Advocate Sachin Gupta pointed out that the post of State Tuberculosis Officer is of the rank of Deputy Director in Health Services and officers of that level are posted in that post.
It was further pointed out that the petitioner and the private respondent, Dr. Poonam Mahajan hold equivalent posts of Medical Officer and the latter is far junior to the petitioner. In the seniority list of Medical Officers dated 11th May 2014, petitioner figures at serial No. 126 whereas the private respondent figures at serial No. 225, he further submitted.
Petitioner’s grievance against the impugned order No. 567-HME of 2015 dated 20th October, 2015 is that the private respondent has been posted as State Tuberculosis Officer over and above her as she is posted as District Tuberculosis Officer, Samba.
Justice Janak Raj Kotwal while issuing notice to the respondents, observed that subject to objections and till next date before the Bench, operation of the impugned order dated 20th October, 2015 shall stay.
