JAMMU: Presiding Officer Fast Track Court Kishore Kumar on Monday issued non-bailable warrants against Sub Inspector Javaid Kataria an Investigating Officer in rape case in police Station Domana.
According to order in bail application titled Rahul Vs State that Petitioner along with counsel present. APP has produced the CD file. Court after Perusal of the CD file reveals that the same has not been maintained in accordance with Police Rules. Perusal of the CD file further reveals that the CD file has been maintained uptill 27th of August, 2016 and thereafter no proceedings have been noted down in the CD file. This action of the IO warrants explanation.
Court after Perusal of order dated 30.08.2016 passed by this court reveals that IO was directed to appear in the court along with CD file. APP has produced the CD file but no explanation has been tendered for the non-appearance of the IO.
As such, non-bailable warrants are issued to secure the presence of the IO to explain the reasons for non maintenance/ completion of the CD file.
