SRINAGAR: The body of a man, allegedly killed by police in Batamaloo area of the city on July 10, was exhumed on Thursday in the presence of a District and Sessions judge following a Supreme Court order to this effect.
“The body of Shabir Ahmad Mir was exhumed from a graveyard in the area for conducting a postmortem to ascertain the cause of his death. It has been taken to a hospital here for autopsy,” a police official said.
The Supreme Court had on August 12 ordered that exhumation and autopsy of the body of the 26-year-old man be carried out under the supervision of the District and Sessions Judge.
Earlier, the deceased’s father, Abdul Rehman Mir, had filed an application before the CJM, Srinagar, alleging his son was killed by police at his home on July 10. He had sought registration of a case against the personnel, including Dy SP Yasir Qadri.
Police, however, claimed that he died during protests in the Valley.
The CJM, on two occasions, directed the SSP, Srinagar, to register an FIR against the police personnel.
The state then filed a petition before the Jammu and Kashmir High Court under Section 561-A CrPC seeking quashing of the CJM order. However, it upheld the order and directed to proceed in the case as per law.
Later, in a notice to the SSP, Srinagar, the CJM court asked why contempt proceedings should not initiated against him and directed the IGP, Kashmir, to register an FIR against the accused police personnel.
When the IGP also did not comply with the orders, the CJM initiated contempt proceeding against him and the SSP. Subsequently, the state filed a Special Leave petition in the Supreme Court. The apex court had on August 9 stayed the contempt proceedings against the two officers.
